Tour Booking – Terms & Conditions
These terms and conditions apply to all Bookings made between us.
Please read them carefully before making a Booking with us.
- Definitions and Interpretation
In these terms and conditions, the following words shall have the following meanings:
Booking the reservation made by you or any person on your behalf for a Tour arranged by us.
Confirmation Email an email sent by us to you in accordance with clause 2.2.
Deposit the deposit payable through our Online System or over the phone.
Force Majeure any circumstances which are unusual and/or unforeseeable which are beyond our control, the consequence of which could not have been avoided even if all due care had been exercised, including (but not limited to) war or threat of war; riot; civil strife; hostilities; political unrest; government action; industrial dispute; natural or other disaster; nuclear incident; terrorist activity; weather conditions; closure of airports; fire; flood or drought.
Tour the tour that you have booked. A tour is 1 day or less and excludes accommodation booked by Bainton bikes. - Bookings
- A Booking is made by you by either booking through our Website or phoning us and by email. It also includes third party booking sites but is not limited to only our terms in this case.
- Upon acceptance by us of your completed booking a binding contract is formed between us on the terms and conditions set out below. We will then confirm your Booking by issuing a Confirmation Email to you in respect of the same. The Confirmation Email will detail where and when the tour is to take place.
- We reserve the right not to accept or fulfil a Booking.All Bookings are subject to availability.
- When a Booking is made by one person on behalf of another person or other people (as the case may be), the person making the Booking confirms to us that he or she has the authority to make such Booking on behalf of the other person(s) (as the case may be).
- What we provide
We will arrange for your chosen Tour and will provide:
(a) a bicycle of the correct size that has been maintained by a qualified mechanic.
(b) a secure place to leave luggage at your own risk
(c) a knowledgeable tour guide. - Own Cycles & Helmets
You may bring your own cycle but we cannot delay the tour if you have a problem with your own cycle. Helmets are not guaranteed and their safety cannot be assured if one is borrowed as they are a used item. - Your responsibilities
- You are responsible for ensuring that you are physically fit enough to undertake the Tour you have booked. We do not accept any responsibility for your failure to complete your Tour due to lack of fitness, illness or injury.
- You accept that cycling on a public highway or cycle route carries its own risks and you have made your Booking on the basis that you undertake the Tour at your own risk.
- You will ride your cycle responsibly at all times.
- Price and Payment
- In consideration of our arranging your Tour in accordance with these terms and conditions you will pay us the price per person for the Tour of your choice. Upon placing your Booking the full amount is payable. No Bookings will be confirmed until such payment is received by us.Payment will be accepted by us by direct bank transfer or by credit and debit card. We have secure online payment options also.
- The prices on the Booking Form or online booking system on the website are correct at time of website publication, however, we reserve the right to raise or lower our prices at any time.
- Customer Cancellations & Alterations
- Tour bookings can be cancelled 48 hours before the tour is due to depart.
- Tour Bookings may be changed to another scheduled tour up to 24 hours before the tour is due to depart, without any extra cost. This does not apply to private tours
- No refund or alteration will be made to bookings after 24 hours before the tour is due to start
- Tours booked through third parties should be cancelled through Bainton Bikes as well as the third party process
- Tours booked with special external party requirements may be subject to additional charges (rental vehicles, hotels etc)
- Tours can only be cancelled with Bainton Bikes via email or through our website
- Group Booking Cancellations
- Group cancellations retain several bikes otherwise hireable, for this reason no matter when a group tour is cancelled 20% is non-refundable.
- Tour Bookings cancelled 1 week before tour is due to depart are eligible for an 80% refund
- Tour Bookings cancelled 48 hours before tour is due to depart are eligible for a 50% refund
- No refund or alteration will be made to bookings after 24 hours before the tour is due to start
- Tours booked with special external party requirements may be subject to additional charges (rental vehicles, hotels etc)
- Group tours should be cancelled via the original source of the tour booking
- Alterations can be made to any group tour up to 48 hours before a tour start date but will be subject to cancellation refund percentages outlined above
- Adverse Weather
- Tours will depart if it is raining or snowing
- If it is raining heavily and continuously for 15 minutes from the time the tour is due to depart and it is requested by the guests the tour can be rescheduled or if unacceptable the tour refunded (for groups 20% is retained)
- The participants of the tour must be at the tour start point at the agreed time
- Refunds
- Refunds will be issued by the payment method that was used to book the tour, card payments will be processed when the tour is cancelled
- Refunds required through BACS will need to be arranged with the Bainton Bikes team member who booked the tour
- Cash payments will need to visit the shop for a refund
- Cancellations & alterations by Bainton Bikes
- Bainton Bikes reserve the right to alter the tour schedule, or route due to any circumstances beyond their control.
- Bainton Bikes reserves the right to cancel a tour due to any circumstances beyond their control, full alternative dates or full refunds will be available.
- Should a customer arrive late without prior notice, the tour will start without them and a new tour will need to be booked (valid for public groups), for private tours the duration of the tour may need to be reduced accordingly
- Our Liability To You
- We accept responsibility for death, personal injury and direct loss suffered by you which you can demonstrate was caused by our negligence up to the limit set out in clause 9.3 below.
- We will not be liable to you where any alleged loss or damage results from:
(a) any of your own actions or omissions or those of any member of your party;
(b) the action or omission of a third party not connected with the provision of your Tour; or
(c) an event or circumstances which we could not have predicted or avoided even after taking all reasonable care;
(d) where any loss or damage is considered to be indirect or consequential loss. - Except in respect of death and personal injury, in respect of which no limit of liability shall apply, our total liability to you under this contract between us shall be limited to the total cost of your Booking.
- We shall have no liability to you if we are unable to fulfil a Booking due to an event of Force Majeure.
- You accept that if leaving your luggage with us that your luggage and contents are left at your own risk. We do not accept responsibility for any loss or damage to luggage and their contents.
- Data Protection
- Except where expressly permitted under the Data Protection Act 1998, we will only use your personal details in connection with your Booking arrangements, unless you agree otherwise.
- We will keep your personal details secure in accordance with our obligations under the Data Protection Act 1998

- General
- These terms and conditions constitute the entire agreement between us, and supersede any previous agreement or understanding and may not be varied except in writing between us. All other terms, express or implied by statute or otherwise, are excluded to the fullest extent permitted by law.
- Any notice required or permitted to be given by either of us to the other under these terms and conditions shall be in writing.
- No failure or delay by either of us in exercising any of its rights under these terms and conditions shall be deemed to be a waiver of that right, and no waiver by either of us of any breach of these terms and conditions by the other shall be considered as a waiver of any subsequent breach of the same or any other provision.
- If any provision of these terms and conditions is held by any court or other competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these terms and conditions and the remainder of the provision in question shall not be affected.
- Except as otherwise expressly provided herein, nothing in these terms and conditions confers or purports to confer on any third party any benefit or any right to enforce any of these terms or conditions pursuant to the Contracts (Rights of Third Parties) Act 1999.
- These terms and conditions shall be governed by English law, and both of us hereby agree to submit to the exclusive jurisdiction of the English courts.
